Please read these terms carefully before using this website or purchasing from TX Power Sports.

Terms & Conditions

NOTE: Vehicles ship separately from accessories.

Important Pre-Ride Tips (Read Before Every Ride)

Storage: Add fuel stabilizer if you plan to store the unit for an extended period.

  1. Ensure every nut and bolt is secured with blue Loctite before each ride.
  2. After 2–4 hours of initial driving, change engine oil to 10W-40. After that, change every 3 months or 100 hours (whichever comes first).
  3. Inspect the vehicle thoroughly before each ride.
  4. Check tire pressure.
  5. Do not exceed the weight limit.
  6. Do not exceed the speed limit.
  7. Brake in your ATV for 2 weeks (use gentle throttle).
  8. Use 93 octane gasoline.
  9. Shift into reverse only after coming to a complete stop.
  10. Read the owner’s manual.
  11. Safety: We are not responsible for any injury.

Return Policy

We strive for quality service and complete satisfaction. If you are not satisfied for any reason, you may return your item within 50 days or 500 miles (whichever comes first) for a refund after deducting handling, delivery, and any other extra charges.

Return Policy Agreement

  • Contact our staff to obtain an RMA (Return Merchandise Authorization) at sales@txpowersports.com. Returns are not accepted without an RMA. Once issued, return the item to the specified address.
  • The customer is responsible for return shipping costs. Freight collect and COD packages will be refused.
  • If a dealer assembles the unit and the customer returns it, the assembly charge is non-refundable.
  • Original packaging/manuals are not required; slightly used items may be accepted with a small deduction. Vehicles with sustained damage are not accepted.
  • 30% restocking fee may apply depending on item condition.
  • No returns on items damaged, altered, or used/maintained contrary to manufacturer recommendations.
  • No returns on refurbished items (all sales final).
  • After 50 days of receipt and if used, you are not eligible for refund or replacement. You may send the vehicle/parts to us at your expense; we will repair and return at our cost.
  • Over 6 months or unauthorized returns may be subject to over 50% restocking fee.
  • Shipping expenses (initial and return) are non-refundable. Original freight cost will be deducted from refunds. (Original shipping cost to you is non-refundable.)
  • Order cancellations before shipment incur a 6% cancellation fee.

Vehicle Registration

Texas Registrants

On-road vehicles require tag, title & registration fees (varies by unit). Our system charges tax only at checkout. We will email you an invoice for the remaining title, e-tag, registration & inspection fees (minus taxes paid). Once paid, we will send your license plates.

Non-Texas Registrants

On-road vehicles must be tagged, titled, and registered per your state’s laws. Where an MCO is required, TXPS will provide an MCO and bill of sale.

Shipping Policy

Our shipping policy outlines free shipping eligibility, processing times, methods, transit times, surcharges, cancellation terms, and customer responsibilities.

Free Shipping

We offer free shipping on select units to most locations in the continental U.S. Excluded areas include Hawaii, Alaska, U.S. territories, international destinations, and certain remote locations such as Manhattan, Key West, and islands accessible only by boat or plane. Some distant states or regions (e.g., NY, WA, SD, ND, MI, CA, MT, OR, NV, ME, MA, PA, CT) and larger car-carrier deliveries may incur additional surcharges.

Order Processing

  • Standard processing time: 48–72 hours after payment.
  • Weekend and holiday orders process within 3–4 business days.
  • Phone verification is required before shipping.
  • Fully Assembled & Ride Test packages may require additional time due to weather or mechanical factors.
  • Processing may take longer during holiday seasons.

Shipping Methods

  • Small packages (under 120 lbs) ship via UPS, FedEx, or USPS.
  • Large freight (120 lbs or more) ships via LTL carriers such as UPS Freight, FedEx Freight, SAIA, R&L, and Roadrunner. The carrier will contact you to schedule delivery.

Transit Times

  • Parts and accessories ship via UPS/USPS with standard delivery times.
  • Vehicles (LTL freight) typically deliver within 2–10 business days, depending on distance from the nearest distribution center.
  • Holiday seasons may add 3–5 business days to delivery.
  • Orders cannot be canceled or refused due to extended transit schedules.
  • If your item does not ship within 14 business days (excluding time waiting on customer information), you may request to cancel for a full refund.

Surcharges

  • Less than 1% of U.S. locations may require a fuel or special-service surcharge, even on free shipping.
  • About 99% of customers will not incur any shipping or fuel surcharges; however, approximately 1% may receive surcharges on a case-by-case basis.
  • Very distant states and some rural areas (e.g., NY, WA, SD, ND, MI, CA, MT, OR, NV, ME, MA, PA, CT, DC, NH, East Coast, and any islands) may incur extra charges.
  • Please place your order normally; if any extra charges apply, we will contact you.
  • We do not ship to Hawaii and Alaska.

Order Cancellation

  • Before shipment: orders may be canceled with a 6% cancellation fee.
  • After shipment: cancellations are not allowed. Refused deliveries will incur return freight charges plus a 30–35% restocking fee depending on item condition.

Customer Responsibilities

  • Arrange pickup or receive delivery once the order has shipped.
  • Respond promptly to carrier notifications.
  • Schedule delivery appointments as needed.
  • Failure or refusal to accept delivery may result in storage fees and shipping charges, which are the customer’s responsibility.

Warranty (Summary of Exclusions)

Warranty applies to engine and manufacturer-defective parts only. We do not cover:

  • Compensation for inconvenience or loss of use; shipping for defective parts to/from us; third-party labor or extra parts needed for installation.
  • Filters, hoses, lubricants, gaskets.
  • Normal wear items: plastics, brakes/handles, seats, lights, belts, tires, batteries (starter batteries provided by manufacturer only).
  • Consequential/incidental damages (rental, income loss, towing, calls, property damage, legal fees).
  • Extreme riding, racing/competition, commercial or rental use, vandalism, fire, theft, crash/accident, unauthorized repair.
  • Towing or shipping charges.

Warranty effective only if:

  1. Product is completely and correctly assembled (tighten and check/Loctite all fasteners).
  2. Used under normal conditions for its intended purpose.
  3. Receives all required maintenance/adjustments.

Units ship brand new, inspected, in a metal crate; customer assembly required unless you purchase assembly/testing. For assistance call 817-649-7823.

Assembly & Repairs: Must be performed by a reputable shop or certified mechanic. Keep all maintenance records. Labor is not covered, even under warranty. You accept the vehicle in working order at pickup/delivery after your inspection.

  • Off-Road ATV/UTV/Dirt Bike/Go Kart: 1-year engine repair/replacement (parts & in-house labor), 90-day limited warranty on all other parts unless noted.

System Definitions (Coverage Context)

Engine (Lubricated Parts): Pistons, rings, wrist pins, connecting rods/bearings, camshaft/bearings, timing chain, crankshaft/main bearings, oil pump, water pump (if applicable), valves/springs/guides/seats/lifters/push rods. Heads/cylinders covered only if damaged solely due to failure of an internal lubricated component.

Transmission (Auto/Standard): Flywheel, hydraulic shift linkage, kick start spindle/gear, transmission gears; case covered only if damage solely from internal component failure.

Drive System: Differential/gears, driveshafts/axles, CV joints, axle bearings, reverse gears/output shafts; housings covered only if damage solely from internal component failure.

Fuel System: Carburetor, vacuum fuel pump, intake manifold, fuel tank/petcock. (If/when EFI models are offered: injectors, electronic pump, fuel rail, regulator.)

Electrical: Stator/pickup/magneto, regulator/rectifier, CDI, starter relay/solenoid/motor (where applicable), coil, distributor assembly, injector relay (if applicable).

Cooling (Liquid-Cooled): Radiator/cap, thermostat/housing, temp sensor/switch, fan motor(s), water pump/housing.

Brakes: Calipers, drum housings/linkage, reservoirs, rotors, lines (pads/linings not covered).

Chassis: Frame, swing arms, A-arms, steering controls (linkages, rod ends, boxes/racks).

Intake & Exhaust: Airbox, intake manifold, exhaust pipe, muffler.

Check Your Vehicle on Delivery

Inspect at delivery and note any shipping damage on the Bill of Lading with the driver present, then notify us immediately. Failure to note may void replacement parts eligibility.

Most vehicles ship factory-packaged and require professional assembly/inspection. TX Power Sports offers PDI (Pre-Delivery Inspection)—see product pages for details.

Maintain Your Vehicle

Follow the Owner’s Manual and Scheduled Maintenance Guide. Keep receipts/records. Failure to perform maintenance invalidates coverage for affected parts.

Coverage & Limitations

  • Initial assembly & preparation must follow our Delivery Prep & Inspection Form and be performed by professional technicians or authorized dealers. Mail the signed form to TX Power Sports and retain receipts.
  • We will replace covered components that fail due to mechanical failure of internal lubricated parts within the warranty period when used as intended.
  • Units are for recreational/transportation use only. Abuse/misuse may void claims.

Examples of Abuse/Misuse

  • Jumping, stunt riding, racing, constant wide-open throttle
  • Rental/commercial use; accident damage; deep-water ingestion
  • Fire/explosion/freezing; theft/vandalism/riot
  • Contaminated/improper fluids or fuel; non-TXPS modifications
  • Improper clutch/brake adjustment or operation
  • Improper reverse engagement while moving forward
  • Lack of scheduled maintenance; non-professional repairs
  • Incorrect lubricants; improper setup; aftermarket parts

Excluded Maintenance & Wear Items

Owner is responsible for routine maintenance (e.g., oil/fluid changes, filters, brake pads, tire rotation, cleaning/polishing, clutch/engine tune-ups).

Warranty Claims Process

  • All warranty work is processed/performed by TX Power Sports. Contact us first.
  • Provide invoice (model, VIN, purchase date) and your signed Delivery Prep & Inspection Form.
  • After obtaining an RMA, ship the original part(s) to us for inspection/testing. Replacement parts will not be sent until we receive the original part(s).
  • Some parts may ship from overseas and can take up to 8 weeks.
  • Customers pay shipping to TX Power Sports for warranty components; we cover shipping of repaired/replacement parts back to the original owner per Limited Warranty terms.

Towing Charges: Customer responsibility. Labor Charges: Not covered for wear items or damage due to abuse/shipping/misuse.

Shipping-Damage Claims: Must include a completed claim form with detailed photos.

Important: TX Power Sports determines manufacturer defect vs. abuse/misuse. We are not responsible for lost time, inconvenience, loss of transportation/use, injury damages, rentals, lost profits/income, or other incidental/consequential damages.

Null & Void Conditions

  1. We are not given reasonable opportunity to inspect covered parts before removal/repair/replacement.
  2. Damage caused by non-covered or third-party parts not purchased from TXPS.
  3. Failure to follow break-in/maintenance requirements or provide records.
  4. Vehicle used in any competitive riding.

No Implied Warranties or Agreements

No agreements/warranties, express or implied (including merchantability/fitness), beyond this Limited Warranty. Applies only to the original customer and is non-transferable.

No Warranty on vehicles intended for racing purposes only.
